Services Description
The Website and Services provide online assessments, diagnostic tools, and related proprietary content primarily designed for startup founders and business leaders. Access to the Services, particularly the assessments, is granted via a unique link and password (or other credentials) provided directly to you.
Intellectual Property and Assessment Confidentiality
Ownership of Content.
The Services, including all text, graphics, images, software, trademarks, service marks, logos, and, critically, the assessments, questions, answers, and scoring methodologies (collectively, the “Content”) are and shall remain the exclusive Intellectual Property (IP) of Ktaria and are protected by copyright, trademark, and other applicable UK and international intellectual property laws.
Assessment Confidentiality.
All assessments, diagnostic tools, test questions, and related content are Confidential Information and Intellectual Property. Your access is granted solely for the purpose of taking the assessment as an individual user.
Strict Prohibition on Copying/Sharing.
You are strictly and expressly prohibited from using, copying, reproducing, distributing, modifying, publishing, or sharing any part of the assessment Content, the assessment link, or your login credentials, for any purpose outside of taking the assessment as instructed.
This prohibition includes, but is not limited to:
- Screen-shotting, photographing, or video-recording the assessment.
- Copying or transcribing test questions or answers.
- Posting assessment content on any website, forum, or social media platform.
- Sharing or distributing your unique login password and link to any third party.
User Obligations and Prohibited Conduct
Accurate Information.
You agree to provide accurate and complete information when registering for and using the Services.
Account Security.
You are responsible for maintaining the confidentiality of your password and access link. You agree to notify us immediately of any unauthorized use of your credentials.
Prohibited Conduct.
You agree not to use the Services to:
- Violate any applicable law or regulation.
- Attempt to gain unauthorized access to the Website or its systems.
- Interfere with or disrupt the security features of the Services.
- Engage in any form of data mining, scraping, or extraction of Content.
- Cheat or attempt to unfairly influence the outcome of any assessment.
Termination
We may terminate or suspend your access to the Services immediately, without prior notice or liability, if you breach these Terms, particularly Section 3 (Intellectual Property and Assessment Confidentiality). Upon termination, your right to use the Services will immediately cease.

Limitation of Liability
To the fullest extent permitted by applicable law, in no event shall Ktaria, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any Content posted or copied by a user in violation of these Terms.
Governing Law
These Terms shall be governed and construed in accordance with the laws of England and Wales, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
